Industrial Design

WHAT IS AN INDUSTRIAL DESIGN?

An industrial design is the shape, configuration, pattern, ornament or composition of lines or colours of a finished article made by either hand, tool or machine.

An industrial design must be original, novel, and appealing to the eye, which are important criteria when considering registering an industrial design.

WHY REGISTER AN INDUSTRIAL DESIGN?

Registering an industrial design grants the owner copyright of the design for the duration of registration. A design is protected only if it is registered.

HOW DO YOU REGISTER AN INDUSTRIAL DESIGN?

To make an application to register an industrial design in Samoa, the proprietor - or an agent working on their behalf - is required to lodge the application to the Registration of Companies & Intellectual Property Division (RCIP) of MCIL, along with the appropriate fee.

The RCIP Division will then process the application. Once approved, a Certificate of Registration is formally prepared and issued to the Agent or Proprietor.

BUSINESS PROCESS

Below is the usual procedure of processing Industrial Design registration applications:

  1. The Ministry (MCIL) receives the completed application
  2. The application is stamped with the date it was received
  3. Check filing fees/Payments (a Schedule of Fees Form is available to download)
  4. The application is assigned a unique identification Number
  5. A complete file is prepared for the Industrial Design application
  6. A filing receipt is then sent to the Proprietor/Agent
  7. A letter is prepared and dispatched to the Agent/Proprietor advising them of the Industrial Design Number
  8. If the application is incomplete:
    • The Division will advise the Agent or Proprietor to submit the required information
    • Once the outstanding information is received, the Division will then re-assess the application
  9. If the application is complete:
    • A Certificate of Registration is issued and dispatched to the Agent or Proprietor
    • All documentation pertaining to the industrial design application is then filed
REGISTRATION FEE

The base fee to Register an Industrial Design of a single article is SAT$56.00, however please view the Schedule of Fees (PDF) below for full details of all fees payable.
